Prioritize Critical Findings in a High-Load Batch Processor Review

You are reviewing a substantial Python merge request. It removes a synchronous per-request processing path and introduces a batched worker that consumes 40 requests at a time, while the older synchronous path remains available in the codebase. The service has been failing under heavy traffic. After investigating, you have confirmed two findings:
- If construction of the batched worker fails, the new factory returns
Nonerather than falling back to the still-available synchronous implementation. - The merge request description states that one batched instance handles 6,000 requests per second, but the repository's own documentation says the peak load is 8,000 requests per second per instance.
Review these two findings. For each one, assign a severity, describe the likely production impact, list the evidence you would need to validate it, and propose narrowly scoped fixes and tests.
